These Affiliate Terms and Conditions ("Terms") govern the relationship between AYSHAS IT AND ALLIED SERVICES ("Company," "we," "us," or "our") and affiliates, agents, or franchisees ("Affiliates," "you," or "your") who use the Ayshas IT Application money transfer and mobile recharge application ("App") for their business activities. By accessing or using the App as an Affiliate, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using the App.
a. Eligibility: To become an Affiliate, you must meet our eligibility requirements and enter into a separate agreement with us. This agreement will outline specific terms and conditions related to your affiliation with us.
b. App Usage: As an Affiliate, you are granted a limited, non-exclusive, non-transferable, and revocable license to use the App solely for your business operations as outlined in your agreement with us.
a. Compliance: You agree to comply with all applicable laws, regulations, and these Terms while using the App as an Affiliate. You are responsible for the actions of your employees, agents, and representatives using the App on your behalf.
b. Accuracy: You agree to provide accurate, current, and complete information when using the App. You are responsible for maintaining the confidentiality of your account information.
c. Customer Interactions: You are responsible for all interactions with your customers, including money transfers and mobile recharges. Any disputes, refunds, or customer inquiries related to your services will be your responsibility.
All content, trademarks, logos, and intellectual property associated with the App are owned by the Company or its licensors. You are prohibited from using, reproducing, modifying, distributing, or creating derivative works based on such content without explicit permission.
Your compensation as an Affiliate will be outlined in your separate agreement with the Company. Any commissions, fees, or other compensation will be subject to the terms of that agreement.
a. Disclaimer: The App is provided "as is" and "as available" without any warranties or guarantees. We do not warrant that the App will be error-free, secure, or uninterrupted.
b. Indemnification: You agree to indemnify, defend, and hold the Company harmless from any claims, liabilities, damages, and expenses arising from your use of the App or violation of these Terms.
c. Limitation of Liability: To the extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to your use of the App.
We reserve the right to suspend or terminate your access to the App at any time for any reason, including a violation of these Terms or the terms of your affiliate agreement.
We may update these Terms as needed. You will be notified of significant changes through the App or other appropriate means.
These Terms are governed by the laws of [Jurisdiction], without regard to its conflict of law principles.
